In these Terms and Conditions the following words will have the following special meanings:
"Agreement" means any contract between You and Us for the sale and purchase of goods;
"Goods" means any goods to be supplied to You by Us on the terms set out below;
"Us", "We" or "the Company" means White Witch of 1 Church Street, Waltham Abbey, Essex, EN9 1DX, United Kingdom; and "You" or "the Customer" means You, the Customer, whose details are set out in the Order.
2. MAKING AN ORDER
You can place an order for Goods (an "Order") by:
2.1 Completing the electronic order form on our website, or:
2.1.2 By calling the Company on 01992 712 794.
2.2 When We receive Your Order We will acknowledge it as follows:
2.2.1 Where an email address is provided confirmation will be sent by email;
2.2.2 Where an email address is not provided, We will confirm by telephone.
2.3 Goods are subject to availability and We reserve the right to refuse to accept any Order for any reason. In the event that We are unable or unwilling to supply the Goods, We will inform You as soon as possible and, where You have already paid, give You a full refund.
2.4 The price You pay for the Goods is the price displayed on our current promotional literature, catalogue or website at the time We receive Your Order, plus any applicable delivery charges (see section 4. below). Whilst We try to ensure that the prices set out in all our promotional literature are correct, errors can occur. If We discover an error in the price of the Goods You have ordered, We will inform You as soon as possible and give You the option of reconfirming Your Order at the correct price or, alternatively, of cancelling Your Order. If We are unable to contact You, We will treat the Order as cancelled. If You cancel Your Order and have already paid for the Goods, You will receive a full refund.
2.5 If any Goods You order are not available, We will contact You to discuss how You wish to proceed. If We are unable to contact You, We will use our discretion and either (i) send a substitute for the unavailable item(s), (which, if You wish, You can return and receive a full refund); or (ii) refund You the price of the unavailable item, if You have already paid for the Goods.
2.6 All prices shown are in £ sterling but exclude delivery charges, which are calculated and added at the point of checkout by You selecting Your preferred delivery method.
2.7 Payment may be made by debit or credit card, or PayPal.
2.7.1 When payment is made by credit or debit card, We will take Your card details when the Order is made, although Your card will not be debited until the goods are ready for dispatch.
3. DESCRIPTION OF GOODS
We cannot guarantee that the appearance and/or colour of Goods shown in our promotional literature or on our website exactly reproduce the appearance and/or colour of the physical Goods themselves. All sizes and measurements quoted are approximate.
4.1 Our delivery charges for the United Kingdom are calculated and added at the point of checkout on Our website by You selecting Your preferred delivery method.
4.2 For Orders outside the United Kingdom, You are required to select Your country of location at the point of checkout on Our website. We will then contact You via email with a choice of delivery price(s).
4.3 Please allow up to 7 days for delivery - unless the item is temporarily out of stock, in which case you will be notified by email. If the delivery period is likely to be longer than 30 days from the date of Your Order, We will notify You as soon as possible, and You will have the right to cancel Your Order. If You exercise this right to cancel, You will receive a full refund within 14 days of doing so.
4.4 Delivery is made by Royal Mail on a non-signature basis.
4.5 As soon as We deliver the Goods to You, You are responsible for their safekeeping. We will not be responsible for any damage or fault arising from incorrect storage or use.
4.6 Ownership of the Goods shall pass to You when We have processed and received full payment of all sums due in respect of the Goods, including any applicable delivery charges.
5. CANCELLATION, RETURNS AND REFUNDS
5.1 We recommend that You keep Your receipt, which will be enclosed with the Goods, as You might need it as proof of purchase in the event of any after-sales queries. We also recommend that you check Your Goods carefully before using them.
5.2 MONEY BACK GUARANTEE
5.2.1 You may cancel Your Order for any reason before delivery or within 14 days after the date of delivery. The Goods must be unused, as new, in saleable condition and returned in their original packaging, wherever possible. Please contact us by email (email@example.com) or on 01992 712 794 within 14 days of delivery and We will advise you how to return Your Goods - lines are open from Wednesday to Saturday 10.30am to 4.30pm.
5.2.2. EXEMPTIONS - There are some circumstances where the Consumer Contracts Regulations do not give You right to cancel. These include, CDs, DVDs and software where You have broken the seal on the wrapping, perishable items, tailor-made or personalised items (e.g. robes or cloaks).
5.2.3. Goods which are not faulty must be returned to us in order for the refund to be paid.
5.2.4 You will receive a full refund for Goods returned under our Money-Back Guarantee.
5.2.5 We recommend You use a signed for delivery service to ensure safe return of the Goods.
5.2.6 A deduction in refund can be made if the value of the Goods has been reduced as a result of You handling the Goods more than was necessary. The extent to which the Customer can handle the Goods is the same as it would be if You were assessing them in a shop.
5.3 FAULTY GOODS - If any Goods You purchase are faulty, We may offer an exchange or refund, as appropriate. This does not affect Your legal rights. Please contact us by email (firstname.lastname@example.org) or on 01992 712 794 within 21 days of delivery and We will advise you how to return Your Goods - lines are open from Wednesday to Saturday 10.30am to 4.30pm.
We may delay delivery, cancel the Agreement or reduce the volume of Goods ordered by You (without liability to You) if We are prevented from or delayed in carrying on our business due to circumstances beyond Our reasonable control.
6.1. Each of Your or Our rights or remedies under this Agreement is without prejudice to any other of Your or Our rights or remedies.
7.1 The Company collects and stores information about You to allow Us to process and fulfill Your Order. We will collect and store any personal data that You may volunteer whilst using Our services. Your personal data collected by Our website is used to:
7.1.1 Take and fulfil Customer Orders;
7.1.2 Administer and enhance the site and service.
7.3 The type of information We collect will include:
7.3.1. Your title and name;
7.3.2 Your address;
7.3.3 Your contact telephone number(s);
7.3.4 Your email address;
7.3.5 Your Order and payment details.
7.3.6 Your payment details will be purged from Our system once Your payment has been processed.
7.4 The Company does not disclose Your information to third parties, other than when Order details are processed as part of the Order fulfilment, for goods delivery purposes. In this case, the third party will not disclose any of Your details to any other third party. We are committed to protecting Your privacy. We will only use the information that We collect about You lawfully, in accordance with the Data Protection Act 1998. We aim to safeguard Your privacy, whilst providing the highest quality of service. You will never receive unsolicited emails, telephone calls or mail from Us. We will only contact You to acknowledge Your Order, if Goods are unavailable, or in response to Your request.
7.5 Cookies are used on this shopping site where they are strictly necessary for the site functionality. They are used to aid navigation, and to keep track of the contents of Your shopping basket.
